Class I recall: Premier Protein Chocolate / Vanilla / Café Latte RTDs in Lyons Magnus Cronobacter / C. botulinum recall

On August 10, 2022, Lyons Magnus expanded its July 28, 2022 voluntary recall of nutritional and beverage products for potential microbial contamination (including Cronobacter sakazakii and Clostridium botulinum) affecting Premier Protein Chocolate, Vanilla, and Café Latte 11 fl oz ready-to-drink shakes. FDA Food Enforcement lists the lines as Class I recall numbers F-1623-2022, F-1624-2022, and F-1625-2022 under event_id 90667, recalling firm Lyons Magnus, Inc. (Fresno, CA), with product descriptions stating the shakes were distributed by Premier Nutrition (Emeryville, CA) and distributed nationwide. openFDA records recall initiation July 22, 2022, center classification August 30, 2022, and termination July 25, 2024. Premier Protein's consumer recall page states only 11 oz cartons with BT in the lot code are affected. The openFDA product_quantity figure (about 53.8 million total units) covers all products in the Lyons Magnus recall family, not Premier Protein SKUs alone. This is a Premier Protein-branded co-packed RTD inside a Lyons Magnus facility recall — not a Premier Nutrition plant enforcement action. Optimum Nutrition Gold Standard RTDs from the same Lyons Magnus event are logged on the Optimum Nutrition Case Log (F-1661-2022 and F-1662-2022), not on this card.

Prop 65 out-of-court settlement: ERC lead claims on Premier Protein bars ($102.5k)

Under California Attorney General Prop 65 notice 2013-00696 (served July 19, 2013), Environmental Research Center alleged Premier Nutrition Corporation / Premier Protein, Inc. / Joint Juice, Inc. sold Premier Protein Double Chocolate Crunch and Premier Protein Crisp Crunchy Protein Bar Chocolate Mint in California with lead exposures requiring Proposition 65 warnings. The CA OAG hosts settlement PDF 2013-00696S3624 — a private Settlement Agreement and Release, not a court consent judgment; the registry lists the court name as Case Settled Out of Court and the docket as N/A — under which Premier agreed to pay a total of $102,500 ($26,068 civil penalties, $52,909 payment in lieu of further civil penalties, $15,613 ERC costs, and $7,910 attorney's fees), and to restrict California sales of Covered Products with more than 0.5 micrograms of lead per maximum recommended daily dose unless a compliant warning is used or the product is reformulated, with ICP-MS testing. The agreement states it is not an admission of Proposition 65 liability. The Premier signature block is dated June 29, 2014; the hosted PDF metadata CreationDate is August 29, 2014. Covered Products are protein bars, not Premier Protein ready-to-drink shakes.
