Prop 65 consent judgment: ERC lead settlement covering Legion Pulse, Genesis, Atlas, and Triumph
In Environmental Research Center, Inc. v. Legion Athletics Inc., Alameda County Superior Court No. RG20056711, the California Attorney General hosts Prop 65 judgment PDF 2019-01822J4444 (settlement twin 2019-01822S8474). The complaint was filed March 2, 2020 after a September 24, 2019 60-day notice (AG 2019-01822) and a January 16, 2020 second notice (AG 2020-00106) alleging failure to warn for lead in twelve Covered Products: Atlas Weight Gainer Chocolate; Genesis Greens Superfood Acai Berry and Original; Pulse Pre-Workout Drink (Blue Raspberry, Fruit Punch, Green Apple, Tropical Punch, Pink Lemonade, Grape); Pulse Stim-Free Fruit Punch and Blue Raspberry; and Triumph High-Performance Multivitamin. The stipulated consent judgment permanently enjoins manufacturing, distributing into, or directly selling in California any Covered Product that exposes a person to more than 0.5 micrograms of lead per day unless it meets the judgment's warning requirements, with a specified testing protocol. Defendant agreed to pay a Total Settlement Amount of $85,000 (civil penalty $38,700 split 75% OEHHA / 25% ERC; ERC costs $6,141.58; Additional Settlement Payment $28,874.34; ERC in-house legal fees $11,284.08 — AG host rounds fees/costs $17,426 and ASP $28,874). The Consent Judgment states it is not an admission of any Proposition 65 violation; Defendant denied the claims. The AG registry Settlement Date is March 17, 2020; the Alameda Superior Court FILE stamp and the AG registry Judgment Date both lock entry to July 2, 2020.
FTC warning letter: unsubstantiated COVID-19 prevention/treatment claims for Immune and Triumph
On April 21, 2020, FTC Division of Advertising Practices staff sent a warning letter to Legion Athletics, Inc. (McLean, VA) after reviewing legionathletics.com in April 2020. FTC determined the company was unlawfully advertising that certain products treat or prevent COVID-19, citing quarantine-diet and boost-immune-system content that linked Legion's Immune supplement and Triumph multivitamin, and an Immune FAQ answering "Will Immune help me fight COVID-19?" FTC stated such disease claims require competent and reliable scientific evidence under the FTC Act, ordered that all such claims cease immediately, and demanded a response within 48 hours. The FTC legal-library catalog lists Date Sent as April 28, 2020. This is a staff warning letter, not a consent order or monetary judgment.
