Prop 65 consent judgment: ERC lead settlement covering Nature's Best Isopure fruit RTD Covered Products

In Environmental Research Center v. Nature's Best, Inc. / The Isopure Company, LLC, San Francisco Superior Court No. CGC-11-513929, the California Attorney General hosts Prop 65 judgment PDF 2010-00439J1837 (settlement twin 2010-00439S2602). After a September 4, 2010 60-day notice and a September 6, 2011 complaint alleging failure to warn for lead, the stipulated consent judgment defines Covered Products (CJ §1.4) as five Nature's Best Isopure ready-to-drink fruit flavors — Apple Melon, Pineapple Orange Banana, Mango Peach, Grape Frost, and Blue Raspberry (all package sizes). On and after the Effective Date, The Isopure Company, LLC dba Nature's Best, Inc. is permanently enjoined from manufacturing for sale in California, distributing into California, or directly selling to California consumers any Covered Product with a daily lead exposure rate above 0.5 micrograms of lead, with specified ICP-MS testing. Defendant agreed to pay a Total Settlement Amount of $110,000 (civil penalty $16,000 split 75% OEHHA / 25% ERC; payment in lieu $45,625; investigation costs $24,500; attorney fees $23,875). The Consent Judgment states it is not an admission of any Proposition 65 violation; Defendant denied that the Covered Products require warnings. Counsel approvals cluster around March 22–27, 2013; the San Francisco Superior Court ENDORSED stamp and Judge James J. McBride's Order and Judgment both lock entry to June 27, 2013 (matching the AG registry Judgment Date).

FDA warning letter: Nature's Best Perfect Solid Protein bar — Vitamin D3 & labeling (archive)

On May 7, 2001, FDA's Center for Food Safety and Applied Nutrition (CFSAN) issued warning letter ONPLDS-15-01 to Hal Katz, President of Nature's Best, Inc. (Hauppauge, NY), concerning the Perfect Solid Protein 2.75-ounce Chocolate Raspberry bar. As preserved in the Quackwatch archive of the warning-letter text (no live fda.gov HTML located), FDA concluded the bar was adulterated under FDCA §402(a)(2)(C) because it contained cholecalciferol (Vitamin D3) as an unapproved food additive outside the use limitations in 21 CFR 184.1950, and misbranded under §§403(i)(1), 403(a)(1), and 403(r)(1)(A) for an inadequate statement of identity, a false claim that glycerine is not a carbohydrate, and a high-protein claim without the required protein percent Daily Value declaration. This is a historical Nature's Best corporate warning letter in the Isopure company lineage (pre-Glanbia acquisition). The product is the Perfect Solid Protein bar, not a modern Isopure Zero Carb or Low Carb powder.
