Final judgment: injunctive-only slack-fill settlement (Kline v. Dymatize, Doc 44)

On April 6, 2017, the U.S. District Court for the Southern District of California entered final judgment in Kline v. Dymatize Enterprises, LLC, No. 3:15-cv-02348-AJB-RBB (Document 44). The order finally certifies, for settlement purposes only, an injunctive-relief class under Fed. R. Civ. P. 23(b)(2): all persons in the United States who made one or more retail purchases, between October 1, 2011 through October 13, 2016, of ISO-100, Elite Whey Protein, Elite Casein, Elite Fusion 7, Elite XT, Pursuit RX Recovery Blend, Elite Gourmet, or Pursuit RX Whey Protein. The order's class definition calls October 13, 2016 the date of entry of final approval. Paragraph V states the settlement provides for injunctive relief only and requires no release of rights to statutory damages claims or any monetary claims, so the court ordered that notice need not be provided to the class. For five years from the Effective Date, the injunction orders Dymatize, as to the eight products in the First Amended Complaint, to manufacture them in translucent substrate containers with a window in the label that allows a view of the contents, add the number of servings to the label, and state that the product is sold by weight and not by volume. Dymatize is not required to recall products already on the market. The order awards class counsel $75,000 in attorneys' fees and litigation costs and one-time service awards of $1,500 each to Ronald Patrick Kline and Yesina Reyes Abreu. It enters final judgment, dismisses the action with prejudice as to the released claims, and states the order is not an admission of liability or wrongdoing.
