Prop 65 consent judgment: ERC lead settlement covering BSN N.O.-Xplode / Cellmass / Thermonex
In Environmental Research Center v. Glanbia Performance Nutrition, Inc. d/b/a Bio-Engineered Supplements & Nutrition, Inc., Alameda County Superior Court No. RG15774929, the California Attorney General hosts Prop 65 judgment PDF 2014-00077J2834 (settlement twin 2014-00077S4302). The complaint was filed June 22, 2015 after 60-day notices alleging failure to warn for lead in Covered Products identified in Exhibit A, including BSN Thermonex, EvoTest, Cellmass / Cellmass 2.0, and N.O.-Xplode / N.O.-Xplode 2.0 powder flavors (many marked discontinued). The stipulated consent judgment requires that Covered Products manufactured after the Compliance Date and distributed or sold into California contain no more than 0.5 micrograms of lead per day or carry a clear Proposition 65 warning, with specified testing. Defendant agreed to pay a Total Settlement Amount of $238,750 (civil penalty $77,868 split 75% OEHHA / 25% ERC; ERC costs $8,207.68; payment in lieu $58,746.95; Lozeau Drury fees $61,755.80; ERC in-house fees $32,171.57). The Consent Judgment states it is not an admission of any Proposition 65 violation; Defendant denied the claims. Party signatures cluster around August 26, 2015; the Alameda Superior Court FILE stamp and the AG registry Judgment Date both lock entry to November 5, 2015. This is a BSN-defendant-only total, not a multi-defendant pool.
Prop 65 consent judgment: ELF protein-lead settlement covering BSN Syntha-6 / True Mass (multi-defendant)
In Environmental Law Foundation v. Abbott Laboratories et al., San Francisco Superior Court Nos. CGC-10-503002 and consolidated CGC-10-505382, the California Attorney General hosts Prop 65 settlement PDF 2010-00391S2488 — a [PROPOSED] Consent Judgment as to Certain Defendants. Attachment A defines Settling Defendants for the Bio-Engineered Supplements & Nutrition, Inc. (BSN) bucket as BSN and its affiliates Optimum Nutrition, Inc. (ON) and American Body Building Products, LLC (ABB). Covered Products sold under the BSN brand include Syntha-6, Syntha-6 RTD, Syntha-6 Isolate, Lean Dessert Protein Powder, True Mass, and True Mass 1200 (all flavors, sizes, and forms), plus a broader definition covering protein products supplying at least 5 grams of protein. Settling Defendants agreed to pay ELF a total of $755,000 ($675,000 fees/costs and $80,000 penalties), with each Settling Defendant's equal share $57,272 (Vital Pharmaceuticals and Chemisource higher). The Consent Judgment includes lead-testing and warning-or-reformulation terms (including 3.0 µg lead/day general and 4.0 µg for gainer/chocolate products) and states it is not an admission of Proposition 65 liability. PDF metadata clusters around January 25, 2013; the hosted PDF remains captioned [PROPOSED] with no locked Superior Court file-stamp date on the AG copy, so treat 2013-01-25 as approximate settlement-execution era. Frame as BSN Covered Products inside a multi-defendant Prop 65 consent judgment with ON and ABB affiliates — do not present $755,000 as a BSN-only civil penalty, and do not imply a separate ELF settlement from the Optimum Nutrition Case Log card citing the same PDF.
